These Terms of Service (“Terms”) govern your use of the VizoLabs app (the “App”), provided by VizoLabs (“we,” “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 17 years old to use the App. By using it, you represent that you meet this requirement and that your use complies with all laws that apply to you.
The App lets you generate images and videos using artificial intelligence, typically by providing a source photo and/or a text prompt. Generation is performed by third-party AI providers via our backend. We may modify, suspend, discontinue, or remove any feature, model, or the App itself at any time, with or without notice, and without liability to you.
You agree not to use the App to create, upload, or distribute content that:
To protect our users and infrastructure, we may rate-limit, throttle, or block requests; detect and prevent fraud and abuse; revoke free or promotional tokens obtained through abuse; restrict automated or programmatic access; and refuse, remove, limit, or suspend access for conduct that violates these Terms.
AI output can be inaccurate, unexpected, or unintended, and may not be unique. Content is generated automatically and is provided “as is.” You are responsible for reviewing any output before using or sharing it, and for ensuring your use complies with applicable laws.
The App relies on third-party services (including cloud infrastructure, AI generation providers, and the app stores). Your use may also be subject to those parties’ terms. We are not responsible for third-party services.
The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that generated content will meet your expectations.
To the maximum extent permitted by law, VizoLabs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.
You agree to indemnify and hold VizoLabs harmless from claims and expenses arising out of your content, your use of the App, or your violation of these Terms or any law or third-party right.
You may stop using the App at any time. We may suspend or terminate access if you violate these Terms or to protect the service. Provisions that by their nature should survive (e.g., ownership, disclaimers, limitation of liability) will survive termination.
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Washington, USA will have exclusive jurisdiction over any dispute arising out of these Terms or the App.
We may update these Terms from time to time. We will revise the “Effective date” and, for material changes, provide notice within the App. Continued use after changes means you accept the updated Terms.
If you believe content generated or used through the App infringes your copyright, contact us at the email below with: (a) a description of the copyrighted work; (b) a description of the allegedly infringing material and where it appeared; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law; and (e) a statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf. We will respond to valid notices as required by applicable law.
